Hearing Confirming the Sale of Krückeberg’s Farmstead Prior to Emigration (21 August 1849)

The record is concluded with signatures (or marks) of the parties and attestation by the Amt official Höcker.

Actum Bückeburg am Amte, den 21. August 1849.
In dem auf heute anberaumten Termin hatten der Colon Krückeberg Nr. 10
aus Berenbusch und der Einlieger Wilhelm Bornemann auf Nr. 14 in Nordholz
vor dem Amte sich eingefunden, und der Erstere gab auf geschehenen
Vorhalt zu vernehmen
Zu meiner Stätte, welche ich für 700 rthlr. an den Einlieger Wilhelm
Bornemann verkauft habe, gehören: ein Wohnhaus, ein Backhaus und etwa 1
3/4 Morgen Gartenland sowie respne: Hofraum.
Es haften auf meiner Stätte die nachfolgenden Lasten und Abgaben:
12 Handburgfesten,
5 Erntetage,
6 Tage Waldarbeit,
26 mg 5 d Amtsgefälle,
2 mg 6 d Contribution pro simplo,
5 Eier und 5 d Opfergeld an die
Pfarre in Petzen,
ein Rauchhuhn,
4 d Wächtergeld,
Landfolgen, Wachten, Dorfsfolgen und sonstigen Gemeindelasten.
Dem Käufer wird die Stätte sofort übergeben, und hat derselbe die vom
Tage der Übergabe an fällig werdenden Lasten und Abgaben zu prästieren.
Das Kaufgeld wird sofort entrichtet, in der Art, daß der Käufer die auf
der Stätte haftenden Konsensschulden übernimmt und den Rest der
Kaufgelder bar bezahlt. Die Kosten des Kaufbriefes werden vom Käufer
getragen.
Diesem vorgängig bitte ich um Genehmigung des Verkaufes meiner Stätte an
den Einlieger Wilhelm Bornemann und um alsbaldige Ausfertigung des
Kaufvertrages. Zugleich füge ich die Bitte hinzu, durch die hiesigen
Landesanzeigen meine Gläubiger amtsseitig auffordern zu wollen, ihre
Forderungen bei Amte anzumelden und demnächst ihre Befriedigung aus den
Kaufgeldern zu gewärtigen.
Der Einlieger Wilhelm Bornemann aus Nr. 14 in Nordholz schloß sich dem
Vorbringen des Aktens Krückeberg an und erklärte auf Vorhalt, daß er ein
Vermögen von 150 rth besitze, und die Gelder, welche ihm zur Bezahlung
der Kaufgelder mangelten, vom Colon Rinne Nr. 8 in Evesen vorgeliehen
erhalten werde.

Done at the Amt in Bückeburg on the 21st of August, 1849.
At the hearing appointed for today, the Colon Krückeberg, No. 10 from
Berenbusch, and the Einlieger (cottager) Wilhelm Bornemann, No. 14 in
Nordholz, appeared before the Amt, and the former, upon questioning,
declared as follows:
To my holding, which I have sold for 700 Reichsthaler to the Einlieger
Wilhelm Bornemann, belong: a dwelling house, a bakehouse, and about 1 3/4
morgens of garden land, together with the associated yard space.
The following services and dues are attached to my holding:
12 Handburg services (communal labor obligations),
5 harvest days,
6 days of woodcutting labor,
26 Mariengroschen 5 Pfennigs in Amts dues,
2 Mariengroschen 6 Pfennigs contribution pro simplo,
5 eggs and 5 Pfennigs offering money to the
parish in Petzen,
one smoke-hen,
4 Pfennigs watchman’s fee,
and the customary land duties, watch duties, and village duties,
together with the remaining communal burdens.
The holding will be delivered to the buyer immediately, and
he shall bear the dues and burdens falling due from the day
of delivery onward. The purchase money is to be paid at once,
in such a manner that the buyer assumes the consensual debts
attached to the holding and pays the remainder of the purchase
price in cash. The costs of the purchase deed are to be borne by
the buyer.
Before this, I request approval for the sale of my holding
to the Einlieger Wilhelm Bornemann and the prompt issuance of
the purchase contract. At the same time, I add the request
that, through the local public notices, my creditors be officially
called upon to register their claims at the Amt and to expect
their satisfaction from the purchase funds in due course.
The Einlieger Wilhelm Bornemann of No. 14 in Nordholz joined the
statement of the case made by Krückeberg and declared upon questioning
that he owns property worth 150 Reichsthaler, and that the money which he
lacks to pay the purchase price will be loaned to him by the Colon Rinne,
No. 8, in Evesen.
