Docket Item 4: Draft of Official Order of the Chamber to Officer Creuzinger (25 Nov 1841)

Overview

This page contains two administrative dispositions (Verfügungen) written and signed by Reck—one expressing his opinion on the petition (a Votum), and one ordering that a copy be sent to Officiant Creuzinger for further report (an Abschriftsverfügung).

The first is Reck’s personal opinion (Votum). He records his view that: although Krückeberg’s situation is unfortunate, granting him a loan is impossible because the collateral is insufficient, and repurchasing or selling the Söhren land is undesirable.

He concludes that the petition should simply remain rejected (“bei dem abschlägigen Bescheid … bleiben”).

This was likely written in Reck’s capacity as a Kammer councillor during the evaluation phase.

After recording his opinion, Reck directed that an official copy (Abschriftlich) of the matter be sent to Officiant Creuzinger for a “baldiger gutdienstlicher Bericht”, i.e., a prompt, service-related report — specifically to obtain further information about:

  • the quality and location of the land (Lage und Qualität des Landes), and

  • the price it might fetch if sold.

This second note thus implements administrative follow-up. It doesn’t contradict the first; it supplements it by initiating the next procedural step.

So traurig die Lage des Krückeberg seÿn mag, da sehe ich doch
nicht ein, wie ihm zu helfen. Ein Darlehn zu bewilligen, wo die
Sicherheit so unzureichend, geht nicht an. Eben so unerfreulich
erscheint es mir, daß das angekaufte Land in der Söhre wieder
gekauft werde. Mag Krückeberg, wenn er überhaupt der Schulden
wegen darüber disponiren kann, dieses Land anderweit zu verkaufen
suchen.  Meiner Ansicht kann es bei dem abschlägl[igen] Bescheid
nur lediglich sein Bewerden behalten.

Gesuchs des p Krückeberg No 10 in Berenbusch vom 21. cur. wird
dem pp. Creuzinger mit dem Auftrage anbei zugestellt, baldigst
gutächtlich zu berichten, ob das Land des Supplikanten in der
Söhre seiner Lage und Qualität nach zweckmäßig und zu welchem
Preise angekaufen sein dürfte.

An den Durchlauchtigsten Gnädigsten Regierenden Fürst
und Landes Herren
So sad as Krückeberg’s situation may be, I still do not see how he
can be helped. To approve a loan where the security is so
insufficient is not possible. Just as unwelcome does it seem to me
that the land in the Söhre which he purchased be bought back. If
Krückeberg, on account of his debts, is at all able to dispose of
it, let him seek to sell this land elsewhere. In my view, with the
adverse decision it should simply remain as it is.

Concerning the land offered for purchase by Colon Krückeberg No.
10 in Berenbusch: Copy of the above-mentioned matter, concerning
the petition of said Krückeberg of the 21st of this month, is to
be forwarded to Creutzinger with the instruction attached, to
report promptly by expert opinion whether the land in the Söhren,
considering its location and quality, is advisable and at what
price it ought to be purchased.
